In the Supreme Court, it was said by the state government that the High Court could not give such an order for admission to pre-primary and the state government had decided to enter RTE according to the law. On the other hand, Advocate on behalf of the institution, who was the petitioner in the High Court, told the Supreme Court that admission has been given in pre-primary classes under the RTE Act, but the state government has given arbitrary interpretation of the rules under RTE from 2019-20 session. Significantly, a division bench of Justice MM Srivastava and Justice Shubha Mehta of the High Court had given an interim order to give admission in pre-primary classes from this session on the public interest petitions of Abhuthanam Society and others on May 23. Earlier, on 23 October 2021, the High Court also ordered children to enter pre-primary classes.
