Uddhav Thackeray and Shinde Group in the petitions filed in the Supreme Court, the disqualification of MLAs, inviting Shinde faction on behalf of the Governor, 2 whips of Shiv Sena in confidence vote, elections to allot elections Many issues have been raised like stopping the action of the Commission. Earlier, the Supreme Court had asked both sides to give in writing issues, on which they expect the court to consider.

Shinde Group's argument

Harish Salve submitted a compilation of points for consideration in the court today on behalf of Shinde Group. In the Supreme Court, Shinde Group says that the MLAs of his camp have not left the party. He is in Shiv Sena itself. He is only with the old leadership of the party. In this context, there is no question of his legislators being unworthy. The defection law cannot be such a weapon through which the leaders who have lost majority should also keep the MLAs tied in their favor.

even today, Harish Salve was told that if speakers take time to take a decision on the action of disqualification, will the MLAs not take part in the proceedings of the House meanwhile, are all the decisions taken in the meantime illegal Will be?

Supreme Court question

Amidst the pleas of Harish Salve, Chief Justice NV Ramna said that in such a situation, what will the meaning of party whip remain. Is there no control over the MLA after being selected once. We cannot completely ignore the party. This is not good for democracy. Salve once again reiterated that Shinde Group had not left the party. He is in the party itself. Decorate law means the end of internal democracy in the party.

Uddhav Thackeray Group's argument

Uddhav Thackeray Group says that the MLAs of Shinde Group have left the party against the party. In this context, his claim to be his real Shiv Sena is meaningless. Since the MLAs of Shinde Group have not merged with the BJP. In this context, he is also unqualified for the membership of the assembly.

On this, the Chief Justice questioned that if two groups of the party are claiming themselves to be the real party, then they cannot claim to recognize themselves as a party. Sibal said on this that Uddhav Thackeray Camp claims that 40 out of 50 MLAs are with him, that is, due to the majority figure, it is the real Shiv Sena, but if these MLAs are proven to be unqualified, then in such a case what will happen? Then what will be the basis of this claim. On behalf of Uddhav Thackeray Camp, another lawyer Abhishek Manu Singhvi said that as long as the matter is pending in the court, the Election Commission should not take any decision on the real Shiv Sena claim.

Election Commission also presented its side

Advocate Arvind Dattar appeared on behalf of the Election Commission. He said that if a group claims to be a real party, then the Commission has to take a decision. The scope of the defection law is different. If the MLAs prove to be unqualified, then their assembly will be membership, not their membership from the political party. What is happening in the assembly has no meaning with the membership of the political party.
