Jabalpur High Court has imposed a penalty of Rs 19 lakh on Central Excise, Customs Department Bhopal and Mandideep officials in a 12 -year -old case to stop the container going for export in Mandideep. It is noteworthy that there was Indraprastha Exporters Company in MP Nagar. Its main work was for the export of clothing. The company exported the commodity prepared from the traders in Sant Hirdaram Nagar to the UAE (UAE). Its price was 2.9 crores. This goods was going to go to the container depot of Mandideep to go to the port, but the officials of the custom department stationed at the container depot stopped the goods. The department believed that the exporter violated two separate sections of the Customs Act. This goods is sent out. Due to lack of time, the container was allowed to go in lieu of bank guarantee, but a total penalty of Rs 30 lakh was imposed on it. Later, this amount deposited in the company's bank was withdrawn by the department using its rights, while exporters The case was taken to the Appellate Authority of Customs and Service Tax (CESTAT). In 2016, the CESTATE pronounced the decision in favor of Indraprastha. Asked to return the interest of Rs 30 lakh to the department, but the department did not return the money, the exporter took refuge in the High Court. Giving the verdict on this, Chief Justice Ravi Mali Math asked the department to return all the money with 10% interest. The company left MP, went to Delhi, Ankit Mishra, head of Viandraprastha Exporter, said that he had come to do Bhopal business in 2010. He used to export goods from the traders of Sant Hirdaram Nagar, but after his container was stopped in Mandideep, he felt that it was difficult to do business in other states, so they went back to Delhi. Ankit said that he is getting only 6 years interest in this case. They want the entire 12 -year interest department to give them. They will file a petition again.
